Starry Internet Service Privacy Notice

Starry is committed to protecting your privacy. As an Internet Service Provider, we understand and respect the privacy responsibility that comes along with our central role in your life. This Internet Service Privacy Notice (Privacy Notice) explains how we collect, use, share, and store information when you use the Starry Internet Service (Service), including any Starry equipment required for use of the Service. When you subscribe to and use the Service, we collect information for the limited purposes described in this Privacy Notice, including providing the Service to you, improving the Service, and marketing the Service and other Starry products and services to you.
We do not sell any of the information we collect through the Service, even if it is de-identified, aggregated, or otherwise obfuscated.
We only share information about you with third parties in the limited circumstances described in this Privacy Notice, including to provide or improve our products and services, when it is required by law, or when we have your explicit consent.
Your web browsing history is your business, not ours. We will not use or share information about the websites you visit when you are using our Service for marketing or advertising purposes.
We strive to protect your information from unauthorized access, use, and disclosure.
We will notify you of significant changes to this Privacy Notice.
What information do we collect from and about you and your use of the Service?
We collect information that you provide us directly, including contact information and billing information. When you subscribe to the Service, we collect contact information from you, such as your name, address, telephone number, email address, and username and password you use to establish your account with us. We also collect information about your payment methods, such as your credit card number or other billing information to bill for any services, including Starry Internet Service you purchase from us. We also keep information in our records about your communications with us, such as when you contact Starry customer care or otherwise correspond with us, including through social media platforms. We may also maintain records regarding other services we provide to you.
We collect technical information about your use of the Service. We collect certain technical information when you use the Service. This may include technical information about your internet usage, including the amount of data you may use. We will also collect information about the equipment and devices you use to connect to the internet. We will collect this information through the Starry Station Wi-Fi router, in accordance with the End User License Agreement. When you visit a website or request a service from a website when using our Service, in order to connect you, we collect information about the sites you visit. We do not retain this information, and we do not use this information for marketing or advertising purposes.
We collect fixed location information. When you access our network, we collect general location information, such as the city or zip code that correlates with the license of your device IP address. We may associate your IP address with your physical address. To improve your service and provide customer care, we may also collect telemetry data that identifies when a device is present at the location at which you subscribe to the Service.
We collect information from others. We may collect information from third parties. For instance, if you rent your residence, we may collect your landlord's name and address. We may also collect information from third parties such as research consultants and marketing firms, including commercially available demographic information and interest data.
How do we use the information we collect?
We use information to provide the Service to you. We use the information to provide the Service to you, to bill for the services you purchase from us, to authenticate who you are when you contact us about your subscription, and to provide you technical support. We use the information collected to provide updates, upgrades, repairs, or replacements for any of our service-related devices or software used in providing the Service, as well as to manage and configure our device(s), system(s) and network(s). We also use your information to communicate with you and provide you with customer service, including through recorded or monitored communications between you and our customer care team members.
We use information to evaluate, improve, and protect our services. We use information to understand how the Service is being used, to evaluate and improve the Service, and manage our network. This information allows us to continually improve our technology and Service over time. We may also use the information we collect to comply with applicable federal and state laws and regulations, and to the extent necessary, to protect our rights, our personnel, our property, and the safety of others. We may also use the information we collect to protect the security of the network and our devices, prevent fraud, detect unauthorized reception, use, and abuse of the Service and to enforce any Starry policy, terms of service, or license agreement.
We use information to market our products and services to you. We may, from time to time, use information we collect to market our own or our affiliates’ products and services to you. For example, we may provide you with information about new products, special offers, new features, or updates. These marketing communications will include an option for you to opt-out of such communications in the future and will reference this Notice.
We combine information. We may combine information that we have collected offline with information we collect through your use of the Service, any other services we provide to you, and our website and mobile apps. In addition, we may combine information we receive from a third party with information we already have.
When do we share information with others?
We share information to provide the Service. Certain non-sensitive information, such as your IP address and referring websites, may be publicly available to others when you use the Service. This information is required for the proper functioning of any Internet access service.
We share information with those that perform services on our behalf. We may share information with certain service providers that help us deliver or improve our products and services. For example, we may provide account information to third parties that process payments for us.
We may share information that personally identifies you with your explicit consent. We may ask your permission to share information about you with our business partners for their marketing purposes. We will only share personally identifiable information about you for marketing purposes if you affirmatively consent to such sharing, and we will make it clear to you that you are sharing your information with both Starry and our identified business partner. You will also have an opportunity to review our respective privacy notices before you provide your information. We will never share information that personally identifies you with any other third parties to use for their own marketing without first obtaining your consent to do so.
We may share information with a successor to all or part of our business. We may share information as part of any merger, acquisition, or sale of our company or our assets, or the transition of the Service to another entity. For example, if part or all our business is sold, we may include customer information as part of that transaction.
We also may share information for certain other purposes. We may share information with your permission. We may also share information without your permission as required by law or regulation; to investigate or defend against third-party claims or allegations; or to protect our rights, property, and the personal safety of our employees or that of our customers or others. We will only share information about you with law enforcement pursuant to valid legal process and we will not share the content of your communications without a valid warrant. We will use all reasonable means to attempt notify you of a valid law enforcement request unless legally prohibited, an emergency situation exists involving danger of death or serious physical injury to a person, or we are unable to ensure that you, and no one else, will receive the notice.
What choices do you have about how we use your information?
You consent to this Privacy Notice before we provide you service. We strive to be as clear as possible about what information we collect, why we collect it, what we do with it, and how we share it. You will receive and must agree to our Privacy Notice before we provide you service. This information is also persistently available on our website at https://starry.com/legal.
You can opt-out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you receive from us. Even if you opt-out of receiving our marketing messages, we will continue to send you transactional messages. These include responses to your questions and information about any services we provide you.
We may ask you if you would like to consent to other information collections or other ways we may use this information in the future. You have control over your information, and we will only use or share information that personally identifies you in ways other than those described in this document with your explicit consent.
How do we protect the information we collect?
We use technical, administrative, and physical safeguards to protect against unauthorized access to, use of, or disclosure of the information we collect and store. No security program is 100 percent secure, however. As a result, we cannot guarantee that we will prevent every unauthorized attempt to access, use, or disclose information.
How do we protect Customer Proprietary Network Information?
Section 222 of the Communications Act provides additional privacy protections for information about the quantity, technical configuration, type, destination, location, and amount of your use of the Service. This information, when linked to an identifiable customer of such service, is known as customer proprietary network information or CPNI. As a customer of the Service, you have the right and we have a duty under federal law to protect the confidentiality of CPNI. Those protections are reflected in this Privacy Notice.
What happens if we make changes to this Privacy Notice?
You will find the most current version of this Privacy Notice at www.starry.com/legal. We may make changes to this Privacy Notice at any time. The text of this Privacy Notice was updated on March 1, 2018 to improve the clarity of our description of the circumstances in which we share information with third parties and to better explain the fact that we collect a limited amount of fixed location information. If we make any major changes, we will provide you notice at least 30 days in advance. In most cases, if you continue to use the Service after we have posted or otherwise notified you of changes to this Privacy Notice, that will indicated your acceptance of those changes. However, we will obtain your affirmative consent if we make changes to the way we use information that personally identifies you and that was collected from your use of our service before such change was made.
