Starry AI Assistant Terms of Use

These Starry AI Assistant Terms of Use (the "Terms") sets forth the terms and conditions governing your interaction with and use of the artificial intelligence (AI) powered chat assistant (“Assistant”) provided by Starry, Inc. and its affiliates (together, “Starry” or “we” or “our”) via our websites, mobile applications, or any other platform on which the Assistant is deployed. By initiating, continuing, or otherwise engaging in any conversation with the Assistant, you agree to be bound by these Terms. If you do not agree to these Terms, you must cease all use of the Assistant immediately.

These Terms incorporate and include our Privacy Notice. If you are a subscriber to Starry Internet service, these Terms are also incorporated into and and are part of the Starry Internet Customer Agreement and Terms of Use.

Minimum Age. You must be at least 13 years old to use the Assistant. If you are between the ages of 13 and 18, you must have your parent or legal guardian’s permission to use the Assistant and they must agree to these Terms.

AI Identity. You acknowledge and understand that the Assistant is an artificial intelligence-powered, non-human, automated system. It is not a live Starry employee or agent, except where the conversation is transitioned to a human agent, in which case the live agent will identify themselves.

Accuracy and Reliability. The responses, outputs, and information provided by the Assistant are generated based on its underlying models and the data to which it has access, which includes your account information if you are a Starry customer. Starry does not warrant the accuracy, completeness, or reliability of any information or output provided by the Assistant. You acknowledge that AI errors, inaccuracies, and "hallucinations" may occur. You assume all risks associated with reliance upon any information provided by the Assistant.

No Professional Advice. The Assistant is intended only to provide information about Starry's service, process self-service requests, and execute customer-directed account actions. The Assistant does not provide, and you shall not rely on its outputs as, legal, financial, medical, or other professional advice.

Prohibited Activities. You agree that you will not misuse the Assistant in any way, especially using abusive language, spamming, violating intellectual property rights, attempting to disrupt the Services, or violating any local laws. You may not attempt to reverse engineer or disassemble the Assistant or attempt to defeat our guardrails. As we do not warranty the responses, you may not represent them as facts that you or anyone else could rely on. Starry reserves the right to limit or remove access to the Assistant to anyone who is reasonably believed to have engaged in any of these prohibited activities.

Escalation to Human Agents. You may request to be transferred to a live human agent at any time, particularly for complex issues, disputes, or when you are unsatisfied with the Assistant’s performance. Any prior conversation with the Assistant will be summarized and provided to the live agent.

Account Actions and Authority (Applicable to Customers Only). When accessing the Assistant while logged into your Starry account, you may request and authorize the Assistant to take binding, automated account actions (including but not limited to processing payments, changing billing dates, initiating service holds, or canceling service). By instructing the Assistant to take any such action, you confirm you have the necessary authority to authorize the action and agree to be bound by the outcomes, fees, or charges resulting from the action.

Data Collection and Use. You acknowledge and agree that Starry may collect, store, and process the content of your conversations, as well as associated metadata when you use the Assistant. You also agree that Starry may use the content of your conversations, including personal information contained therein, to improve Starry’s use of the underlying models and the related Starry services. Starry does not use this information to train the underlying models themselves. For more information about how Starry uses and protects your personal information, please refer to our Privacy Notice.

Disclaimer of Warranties. THE AI ASSISTANT IS PROVIDED ON AN “AS IS” BASIS ONLY. EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES MAKE NO WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE AI ASSISTANT, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTION, SECURITY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE OR WARRANT THAT THE AI ASSISTANT WILL BE UNINTERRUPTED, ACCURATE OR ERROR-FREE. ANY AGREEMENTS, PROMISES, OR REPRESENTATIONS MADE BY THE AI ASSISTANT ARE NON-BINDING AND SHOULD NOT BE RELIED UPON. YOU ARE RESPONSIBLE FOR VERIFYING SUCH INFORMATION THROUGH APPROPRIATE AND INDEPENDENT CHANNELS.

Limitation of Liability. Under no circumstances will Starry be liable to you for indirect, special, incidental, consequential, punitive, or exemplary damages arising out of or in connection with the Assistant. Starry's entire liability and your exclusive remedy with respect to your use of the Assistant or any breach of these AI Terms shall be limited to direct damages up to a maximum amount of twenty five dollars ($25.00).

Governing Law. These AI Terms will be governed by the laws of the State of New York without giving effect to any conflict of laws provisions.

Binding Arbitration and Class Action Waiver.

Starry Customers: The Binding Arbitration Provision and Waiver of Jury Trial set forth in the Customer Agreement apply in full to any Dispute arising out of or relating to your use of the Assistant.
Non-Customers: Any Dispute between you and Starry related to the Assistant shall be resolved exclusively through final and binding arbitration as set forth in the Customer Agreement, and you agree to waive any right to a trial by jury or to participate in a class action.

Modifications. Starry reserves the right to change these Terms at any time and without notice. You will be able to see that we made changes by checking the “Updated” date at the top of this page, so please check back periodically. Your continued use of the Assistant after any change constitutes your acknowledgment and acceptance of the change.
